After Resignation (After Finishing One Year Contract Term):

1. YOU’RE ENTITLED FOR LEAVE SALARY (ONE YEAR):

The paid annual leave is calculated as per calendar days. According to Article 79 of Qatar Labour Law, the worker who has completed one continuous year of service shall be entitled to an annual leave with pay for not less than three (3) weeks.

3. NO FREE TICKET:

The employer will not provide Air Tickets for resignation after one year. You need to pay your own money for booking air tickets.

AFTER TERMINATION (AFTER FINISHING ONE YEAR CONTRACT TERM):

1. Your entitiled for one month salary: 

If the employee is employed on a monthly basis the notice period shall be one month and in writing or payment of one month’s salary in lieu of notice.

2. FREE AIR TICKET:

If employer terminated, they need to provide air ticket to employee. Employers must provide air tickets for departing staff.

QUESTION:

I have resigned from a company after working with it for the last 15 years. My full salary is QR7,000 with the basic being QR4,500.  I have gone on vacation four times only in these 15 years. The company offered paid leave for every two years. Does Qatar Labour Law provide paid leave every year? Since I have resigned, can I claim my remaining leave salary and how will it be calculated, every year or two years?

ANSWER:

Upon completion of one continuous year in the service of the employer, the employee shall be entitled to an annual leave with pay. This leave shall not be less than three weeks (Article 79 of Law No 14 of 2004 effective January 2005) /two weeks (prior January 2005 as per Article 47 of Law No 3 of 1962) for the worker whose service is less than five years and four weeks for the worker whose service is more than five years.

The employer may on a written request of the worker postpone not more than half of the annual leave to the year following the year of its entitlement. Article 81 stipulates that the worker shall be entitled to payment in lieu of his annual leave equivalent to his wage for the leave days to which he is entitled if the contract is terminated for any reason before the worker takes his leave.

Discuss the matter with employer and seek assistance from the Labour Department as the worker may not waive his entitlement to the annual leave and any agreement to the contrary shall be void.

QUESTION:

I resigned my last job 3 months before the end of my two-year contract. Since I didn’t complete my contract, my company said I am not entitled for gratuity. Is this true?

ANSWER:

Article (51) of Labour Law provides that “The worker may terminate the work contract before its termination if its period is determined, without informing the employer, if its period is undetermined, in keeping his total rights of the end of service compensation, in each of the following cases:

If the employer fails to fulfill his obligations decided in the work contract or upon this law.
If the employer or the acting manager makes a physical aggression or any immoral act against the worker or his family members.
If the employer or his representative cheated the worker at the time of contract concerning the work conditions.
If there exists a severe danger that threatens the safety of the worker, or his health in condition that the employer knows about the danger and doesn’t work on eliminating it.

QUESTION:

Does the Labour Law state that annual round-trip ticket to home country is a mandatory benefit?

ANSWER:

The Qatari labour law did not regulate issuing tickets for annual leave. 
On the other hand the sponsor shall undertake repatriate the sponsored person upon the expiry or cancellation of the residence permit or upon deportation order. 
Accordingly, annual leave tickets are subject to the administrative aspects of each company separately and are subject to the agreement between the worker and the company operates.

QUESTION:

After how many years of service is an employee entitled for an annual ticket back home?

ANSWER:

Initially the employer is not entitled for an annual ticket, unless the employment contract provides that. However, as matter of practice the employee is entitled for an annual leave for not less than 3 weeks for the employee who served less than five years and 4 weeks for the employee who served for five years or more.
